Terms of Service
Effective 9 September 2026 · Version 1.1
1. Agreement
These Terms govern the review management services provided by Fintier Advisory Group LLC, a Wyoming limited liability company (“we,” “us”), to you, the business identified at signup (“Client,” “you”). By submitting payment you agree to these Terms.
2. Definitions
- Service
- The review management services described in Section 3.
- GBP
- The Client’s Google Business Profile.
- Activation
- The date on which all three of the following are first true: (a) we have been granted Manager access to the Client’s GBP; (b) the Client’s customer data source is connected and delivering customer records to us; and (c) we have sent the first review request on the Client’s behalf. Activation is determined by our systems and communicated to the Client in writing.
- New Review
- A review of the Client’s business published publicly on Google after the Activation date, and still publicly visible at the time of measurement. Edits or updates to reviews existing before Activation are not New Reviews. Reviews on platforms other than Google are not New Reviews.
- Guarantee Period
- The thirty (30) days of elapsed Active Time beginning on Activation.
- Active Time
- Calendar days following Activation, excluding any day on which a Pause Condition (Section 6) is in effect.
3. Services
We will:
- Send automated review requests to the Client’s customers following completed jobs, by email and, where permitted under Section 8, SMS;
- Send one follow-up to customers who do not respond;
- Conduct one campaign to the Client’s existing past-customer list, subject to Section 8;
- Monitor reviews published to the Client’s GBP;
- Publish responses to reviews rated four (4) stars or higher, and submit responses to reviews rated three (3) stars or lower to the Client for approval before publication;
- Notify the Client of any review rated three (3) stars or lower;
- Provide a monthly performance report.
We will not perform any service not listed above without separate written agreement.
4. Fees
The Service is $297 per month, charged to the payment method on file at signup and monthly thereafter on the same day of the month.
5. Performance Guarantee
If we do not obtain at least five (5) New Reviews for the Client during the Guarantee Period, we will refund the Client’s first monthly payment in full.
The following apply:
- The refund is of the first monthly payment only. Subsequent payments are not covered by this guarantee.
- We will issue the refund automatically within five (5) business days of the end of the Guarantee Period. The Client need not request it.
- Upon refund, this Agreement terminates and the Service ends. There is no partial continuation.
- The count is of New Reviews publicly visible at the end of the Guarantee Period. Google may remove or withhold reviews at its sole discretion, and reviews removed by Google before measurement do not count toward the threshold. We do not control Google’s review systems and cannot guarantee any review remains published.
- This guarantee applies to the number of New Reviews only. We do not guarantee any change to the Client’s star rating, search ranking, review sentiment, call volume, revenue, or any other outcome.
- If any payment beyond the first is charged before the Guarantee Period resolves, and a refund becomes due, we will refund those payments as well.
6. Pause Conditions
The Guarantee Period clock pauses, and the paused days do not count as Active Time, on any day on which:
- Our Manager access to the Client’s GBP is revoked, suspended, or otherwise unavailable; or
- The Client’s customer data source has not delivered customer records for more than three (3) consecutive days; or
- The Client instructs us to suspend sending.
We will notify the Client when a Pause Condition begins. If a Pause Condition remains in effect for more than thirty (30) consecutive days, we may terminate this Agreement, and the guarantee in Section 5 will not apply.
7. Client Obligations
The Client will:
- Grant and maintain Manager-level access to its GBP for the duration of the Agreement;
- Maintain a Google Business Profile that is verified with Google;
- Connect and maintain a customer data source that delivers customer contact details and job completion records;
- Provide accurate legal business name, EIN, and supporting IRS documentation as required for carrier registration under Section 8;
- Maintain a publicly accessible privacy policy and terms of service on its website addressing SMS consent, as required by carrier registration;
- Respond to requests for approval of responses to reviews rated three (3) stars or lower;
- Complete onboarding without undue delay, including granting the access described in (a) and connecting the data source described in (c) within ten (10) business days of signup; and
- Respond within three (3) business days to any request from us for access, credentials, documentation, or approvals reasonably required to deliver the Service.
The Client’s failure to meet these obligations may trigger a Pause Condition under Section 6.
Delay before Activation
Fees under Section 4 begin at signup and are not suspended, reduced, or refunded because onboarding is incomplete. The Guarantee Period does not begin until Activation, and time lost to the Client’s delay in granting access or connecting its data source is not Active Time.
If Activation has not occurred within thirty (30) days of signup for reasons within the Client’s control, we may terminate this Agreement on written notice, and the guarantee in Section 5 will not apply.
8. Messaging Consent and Compliance
The Client represents that its customer records were obtained in the course of its business relationship with those customers.
SMS
We will not send SMS on the Client’s behalf until carrier registration is complete. The Client acknowledges that registration is performed by third parties, typically takes several business days, and may be delayed or refused for reasons outside our control.
The Client represents and warrants that every phone number it provides to us has given prior express consent to receive text messages from the Client, and that the Client maintains records evidencing that consent. The Client will provide those records on request.
The Client is solely responsible for the accuracy of this representation and will indemnify us against any claim arising from its inaccuracy, including claims under the Telephone Consumer Protection Act or analogous state law.
We will honor opt-out requests immediately and permanently.
9. Review Policy Compliance
We comply with Google’s review policies. We will not, and will not agree to:
- Create, purchase, solicit, or publish false or fabricated reviews;
- Offer any incentive, discount, gift, or consideration in exchange for a review;
- Filter, gate, screen, or route customers based on anticipated sentiment, including any practice that directs dissatisfied customers away from Google’s public review form;
- Attempt to remove, suppress, or dispute legitimate negative reviews.
We cannot remove negative reviews and do not offer that service. No provider can remove a legitimate review from Google.
If the Client instructs us to take any action listed above, we may terminate this Agreement immediately without refund beyond any amount owed under Section 5.
10. Third-Party Dependencies
The Service depends on Google, messaging carriers, and other third-party platforms. We are not responsible for their availability, policy changes, pricing changes, or decisions regarding the Client’s account, profile, or content, including Google’s removal or withholding of reviews.
11. Data
Client customer data
Customer contact details the Client provides are used solely to deliver the Service. We do not sell, rent, or share them, and do not use them for any other client or purpose.
Deletion
We will delete the Client’s customer data within thirty (30) days of termination, except where retention is required by law. The Client may request deletion at any time; doing so will trigger a Pause Condition and may prevent delivery of the Service.
Our records
We retain records of messages sent, reviews collected, and performance metrics for our own operational and legal purposes.
12. Cancellation and Termination
Either party may cancel at any time with thirty (30) days’ written notice. The Service continues through the end of the paid period; fees already paid are not prorated or refunded except as provided in Section 5.
Upon termination we will cease sending on the Client’s behalf, and the Client should remove our Manager access to its GBP.
We may terminate immediately for non-payment, for breach of Sections 7, 8, or 9, or if continuing would in our judgment expose either party to legal or platform risk.
13. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of or relating to this Agreement will not exceed the total fees paid by the Client in the twelve (12) months preceding the claim.
We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, or loss of business opportunity.
Nothing in this section limits the Client’s indemnification obligations under Section 8.
14. Changes to These Terms
We may modify these Terms with thirty (30) days’ notice to the Client. Continued use of the Service after the effective date constitutes acceptance. Changes do not apply retroactively to a Guarantee Period already in progress.
15. General
Governing law
Wyoming, without regard to conflict of laws principles.
Entire agreement
These Terms are the entire agreement between the parties and supersede all prior discussions, proposals, and representations, including any statement made in marketing materials or email correspondence.
Severability
If any provision is unenforceable, the remainder stays in effect.
Assignment
The Client may not assign this Agreement without our written consent.
